By accessing this website, purchasing products online, or shopping in our physical store, you agree to the following Terms and Conditions in full. If you do not agree, do not use this website or purchase from us.

All Sales Are Final

• All items sold by His-Hers & Ours are sold AS-IS, WHERE-IS, WITH ALL FAULTS.
• We do not accept returns, exchanges, or refunds for any reason except as specifically stated below. This includes but is not limited to:
  • Changed mind
  • Buyer’s remorse
  • Incorrect fit
  • Misunderstanding of item use
  • Color differences
• Condition expectations
• Failure to read description
• Damage after pickup
• Gifts not wanted
• Personal preference

Limited Exception for Electronics (48 Hours Only)

Electronics that were tested and confirmed working prior to sale may be eligible for exchange only if:

• The item stops functioning within 48 hours of delivery or pickup
• You notify us within that 48-hour window
• The item is returned in the same condition it was sold
• After 48 hours, no returns, refunds, or exchanges will be honored for electronics.

Vintage, Antique, Used, and Resale Items:  Most items we sell are vintage, antique, pre-owned, collectible, or resale items. These items:

• May have wear, age, patina, repairs, flaws, or imperfections
• Are sold for decorative, collectible, or hobby purposes
• Are not guaranteed to function as new
• Are sold without warranty of any kind
• Buyer accepts full responsibility for evaluating item condition prior to purchase.

Description Accuracy Disclaimer

We do our best to describe items accurately, however, we are not liable for:

• Mistakes in descriptions
• Incorrect dates, makers, history, origin, or materials
• Misidentification of antiques or collectibles
• Estimates of age or value
• Opinions stated in listings
• Variations in photographs due to lighting or screens
• All descriptions are opinions, not guarantees.

If a mistake is made, please contact us.  We will do our best to make it right, and would never want to intentionally mislead any customer or have there new favorite thing loos it's magic because of this.

Shipping & Insurance

All shipped items are insured through the shipping carrier. If an item arrives damaged:

• The customer must file a claim with the shipping carrier
• We will assist with documentation
• We are not responsible for carrier damage
• No refunds or replacements will be issued by us for shipping damage outside of the carrier’s claim process.

No Liability for In-Store Injuries

Customers enter our store at their own risk. We are not liable for:

• Slips, trips, or falls
• Injury from merchandise
• Injury from tools, hardware, furniture, displays, or fixtures
• Injury from handling items
• Injuries to children
• Damage to personal property while in store
• Parents/guardians are responsible for supervising children at all times.

Use of Tools, Hardware, Outdoor, Hunting, or Utility Items

Items such as tools, hardware, heaters, lanterns, fuels, outdoor gear, hunting-related products, and utility equipment are sold for lawful and proper use. We are not responsible for:

• Misuse
• Improper installation
• Failure to follow safety practices
• Injury or damage caused by improper use
• Buyer assumes all responsibility upon purchase.

No Warranties

All items are sold without any express or implied warranty, including:

• a) Merchantability
• b) Fitness for a particular purpose
• c) Future performance
• d) Longevity
• e) Safety after purchase

Refusal of Service

• We reserve the right to:
• Refuse service to anyone
• Cancel orders
• Refuse returns
• Limit quantities
• Deny sales at our discretion

Charge-backs & Fraud

Filing a charge-back without contacting us first is considered fraudulent activity. We maintain:

• Photographs of items
• Packing documentation
• Condition documentation
• POS records
• Security footage
• These will be provided to banks and authorities in charge-back disputes.

Pricing Errors

We reserve the right to cancel any order due to pricing errors, website errors, or inventory mistakes.

Limitation of Liability

Under no circumstances shall His-Hers & Ours be liable for any:

Indirect damages Consequential damages Loss of use Loss of profits Personal injury after purchase Property damage after purchase Maximum liability shall never exceed the purchase price of the item.

Agreement to Terms

By purchasing in store or online, you acknowledge you have read, understood, and agreed to these Terms and Conditions.

Governing Law

These terms are governed by the laws of the State of Texas. Any disputes shall be handled in the county of our business location.
